Terms of Service

Overview

Welcome to Dry Dock Supply.

This website and online store are operated by Michael Morgan, doing business as Dry Dock Supply. The terms “we,” “us,” and “our” refer to Dry Dock Supply and its owner.

Dry Dock Supply operates this store and website, including the related information, content, features, tools, products, and services offered to customers collectively as the “Services.”

Our store is powered by Shopify, which provides the ecommerce platform that allows us to offer the Services to you.

These Terms of Service, together with the policies referenced within them, describe your rights and responsibilities when using the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to these Terms of Service and our Privacy Policy, available at:

https://drydocksupply.com/policies/privacy-policy

If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

Section 1 — Access and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your state or place of residence.

You may permit minor dependents to use the Services through devices that you own or manage only when permitted by applicable law and under your supervision.

To access certain features or purchase products, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping address.

You represent that all information you provide is accurate, current, and complete and that you have the legal right to provide it.

You are responsible for protecting your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

Section 2 — Our Products

We make reasonable efforts to accurately display and describe our products.

Product colors and appearance may vary depending on photography, lighting, printing processes, garment materials, manufacturing variations, screen settings, and the device used to view the store.

Garment measurements and product specifications may also vary slightly due to normal manufacturing tolerances.

We do not guarantee that every color or visual detail displayed on your device will exactly match the physical product.

Product descriptions, availability, pricing, designs, and specifications may be updated or corrected when necessary.

We reserve the right to discontinue products and to limit quantities available to a person, household, geographic region, or jurisdiction where permitted by law.

Nothing in this section limits any warranties, consumer rights, or remedies that cannot legally be excluded.

Section 3 — Orders

Placing an order constitutes an offer to purchase merchandise from Dry Dock Supply.

We reserve the right to accept, decline, limit, or cancel an order for legitimate reasons, including suspected fraud, pricing or inventory errors, payment authorization issues, product unavailability, or violations of these Terms.

An order is not accepted until payment has been authorized and we provide an order confirmation.

Please review your order carefully before submitting it. Orders may enter processing or production shortly after they are placed, and requested changes or cancellations may not always be possible.

When an order is changed, declined, or cancelled, we will make reasonable efforts to notify you using the email address, billing information, shipping address, or telephone number provided with the order.

Purchases are subject to our Return and Refund Policy:

https://drydocksupply.com/policies/refund-policy

You represent that purchases are intended for lawful personal or household use and not for unauthorized commercial resale or export.

Section 4 — Prices and Billing

Prices, discounts, product availability, and promotions may change without notice.

The price charged will be the price displayed when the order is submitted, subject to correction of genuine errors as permitted by law.

Unless otherwise stated, displayed prices do not include shipping charges, taxes, customs duties, import charges, or other fees that may apply.

Promotions may be governed by separate conditions. When promotional conditions conflict with these Terms, the promotional conditions will govern that promotion.

You agree to provide accurate and complete billing, payment, shipping, and account information and to update that information when necessary.

You represent that:

  1. The payment information you provide is accurate and complete.
  2. You are authorized to use the selected payment method.
  3. Charges submitted through that payment method will be honored.
  4. You will pay all authorized charges, including applicable shipping costs and taxes.

Section 5 — Shipping and Delivery

Processing and delivery estimates are provided in our Shipping Policy:

https://drydocksupply.com/policies/shipping-policy

Delivery dates and transit times are estimates and are not guaranteed unless expressly stated otherwise.

Delays may occur because of production schedules, carrier operations, weather, customs processing, incorrect customer information, service interruptions, or events outside our reasonable control.

We remain responsible for addressing shipping and delivery issues in accordance with applicable law and our published policies.

Nothing in these Terms limits rights or remedies that cannot legally be waived, including rights relating to merchandise that is not delivered.

Section 6 — Intellectual Property

The Services and their original content—including brand names, logos, product designs, artwork, text, photographs, graphics, video, audio, product descriptions, website content, and the selection and arrangement of that content—are owned by, licensed to, or used with permission by Dry Dock Supply.

Applicable copyright, trademark, and other intellectual property laws protect this content.

You may use the Services for lawful, personal, and noncommercial shopping purposes.

Unless expressly authorized in writing, you may not:

  1. Copy, reproduce, republish, or distribute website content.
  2. Modify or create derivative works from our designs or artwork.
  3. Commercially exploit, sell, license, or transmit our content.
  4. Copy or produce counterfeit or competing merchandise using our designs.
  5. Remove copyright, trademark, or other proprietary notices.
  6. Use our trademarks in a manner that suggests an unauthorized affiliation, sponsorship, or endorsement.

Purchasing a product does not transfer ownership of the artwork, brand name, copyright, trademark, or other intellectual property associated with that product.

The Shopify name, logo, products, and services are the property of Shopify or its licensors.

Third-party names, marks, and content remain the property of their respective owners.

Section 7 — Optional Tools

The Services may provide access to features, integrations, or tools offered by third parties.

We may not control or monitor every third-party tool.

Third-party tools may be provided on an “as is” and “as available” basis and may be governed by separate terms and privacy policies.

Your use of optional third-party tools is at your discretion. You should review the applicable provider’s terms and policies before using those tools.

New features, tools, and resources introduced through the Services may also be subject to these Terms.

Section 8 — Third-Party Links

The Services may contain links to websites, applications, platforms, or services operated by third parties.

Dry Dock Supply does not control and is not responsible for the content, availability, security, accuracy, products, services, or privacy practices of independent third parties.

Your use of third-party websites and services is governed by their own terms and policies.

Questions or complaints concerning a third party’s independent products or services should be directed to that third party.

Nothing in this section limits our responsibility for products sold directly by Dry Dock Supply.

Section 9 — Relationship With Shopify

Dry Dock Supply is powered by Shopify, which provides the ecommerce technology used to operate this store.

Purchases made through this store are transactions directly between the customer and Dry Dock Supply.

Dry Dock Supply, not Shopify, is the seller of Dry Dock Supply merchandise and is responsible for its products, orders, customer service, published policies, and customer communications.

Shopify is not responsible for the manufacture, sale, fulfillment, condition, suitability, delivery, return, or refund of Dry Dock Supply products, except to the extent Shopify independently provides a service or assumes an obligation under its own applicable terms.

Section 10 — Privacy

Personal information collected through the Services is handled according to our Privacy Policy:

https://drydocksupply.com/policies/privacy-policy

Because the Services are hosted through Shopify, Shopify may collect and process information concerning your access to and use of the Services to provide, secure, maintain, and improve the ecommerce platform.

Information may also be shared with service providers involved in payment processing, production, fraud prevention, order fulfillment, shipping, analytics, customer support, and other operational functions.

Please review our Privacy Policy for further information about how personal information is collected, used, disclosed, and protected.

Section 11 — Feedback and Reviews

When you voluntarily submit a review, photograph, suggestion, idea, comment, or other content relating to Dry Dock Supply or its products, you grant Dry Dock Supply a nonexclusive, worldwide, royalty-free license to reproduce, display, publish, distribute, adapt, and use that content for legitimate business and promotional purposes.

You retain ownership of your original content.

You represent that:

  1. You own the content or have permission to submit it.
  2. The content is accurate based on your genuine experience.
  3. You have disclosed any relevant compensation or incentive.
  4. The content does not violate another person’s intellectual property, privacy, publicity, or legal rights.
  5. The content does not contain malicious software, unlawful material, or deliberately misleading information.

We may moderate or remove content that violates these Terms, applicable law, or the rights of others.

We are not required to keep submitted feedback confidential, pay compensation for unsolicited feedback, or respond to every submission.

Section 12 — Errors, Inaccuracies, and Omissions

Occasionally, information displayed through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, or estimated delivery times.

We may correct genuine errors, update information, or cancel affected orders when permitted by applicable law.

When a paid order is materially affected, we will make reasonable efforts to notify the customer and provide an appropriate correction, alternative, or refund.

Section 13 — Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

  1. Violate applicable laws or regulations.
  2. Infringe the intellectual property or legal rights of another person.
  3. Submit fraudulent, deceptive, abusive, threatening, defamatory, or unlawful material.
  4. Introduce viruses, malicious code, or other harmful technology.
  5. Attempt unauthorized access to the Services or related systems.
  6. Interfere with the security, availability, or operation of the Services.
  7. Collect personal information about others without authorization.
  8. Send spam, phishing messages, fraudulent solicitations, or harmful communications.
  9. Impersonate Dry Dock Supply, its owner, another customer, or another person.
  10. Scrape, copy, extract, reproduce, or commercially exploit content without authorization.
  11. Create counterfeit merchandise using Dry Dock Supply artwork or designs.
  12. Circumvent reasonable security, access-control, or fraud-prevention measures.

We may restrict or terminate access when reasonably necessary to protect customers, our business, Shopify, service providers, or the integrity of the Services.

Section 14 — Automated Systems and Agents

Automated systems, bots, crawlers, artificial-intelligence agents, and similar technologies may not access or interact with the Services in a manner that:

  1. Violates applicable law.
  2. Bypasses security or access-control measures.
  3. Conceals or misrepresents the automated nature of the activity.
  4. Circumvents CAPTCHAs or other controls intended to distinguish automated activity from human activity.
  5. Collects protected information without authorization.
  6. Interferes with normal website operation.
  7. Copies or commercially exploits protected website content.

We may use reasonable technical measures to regulate or restrict automated access.

Nothing in this section prohibits ordinary indexing by legitimate search engines that comply with our published technical directives.

Section 15 — Suspension and Termination

We may suspend or terminate access to the Services when reasonably necessary because of suspected fraud, unlawful conduct, misuse, security risks, or material violations of these Terms.

Termination does not eliminate payment obligations or liabilities incurred before termination.

Provisions that logically should continue after termination—including intellectual property, feedback licenses, disclaimers, liability limitations, indemnification, governing law, and dispute-related provisions—will remain effective.

Section 16 — Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.

Except for warranties expressly provided by Dry Dock Supply or rights that cannot legally be excluded, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, title, durability, and noninfringement.

Some states or jurisdictions do not permit certain warranty exclusions. In those locations, these exclusions apply only to the maximum extent permitted by law.

Nothing in these Terms excludes consumer rights, warranties, or remedies that cannot legally be waived.

Section 17 — Limitation of Liability

To the fullest extent permitted by applicable law, Dry Dock Supply and its owner, service providers, contractors, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Services.

This may include lost profits, lost revenue, loss of data, replacement costs, or similar damages.

These limitations do not apply where liability cannot legally be limited or excluded.

Nothing in these Terms limits liability for fraud, willful misconduct, or other liability that applicable law does not permit us to exclude.

Section 18 — Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dry Dock Supply, its owner, Shopify, and their respective service providers, contractors, and representatives from third-party claims arising from:

  1. Your material violation of these Terms.
  2. Your unlawful use of the Services.
  3. Your violation of another person’s legal or intellectual property rights.

This obligation does not apply to claims caused by the negligence, unlawful conduct, or breach of duty of a party seeking indemnification.

Section 19 — Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted.

The invalid or unenforceable portion will be treated as severed, and the remaining provisions will continue in effect.

Section 20 — Waiver and Entire Agreement

Failure to enforce a provision of these Terms does not waive the right to enforce that provision later.

These Terms and the policies incorporated by reference constitute the agreement governing your use of the Services and supersede earlier communications concerning the same subject.

Nothing in this section limits representations, warranties, or consumer rights that cannot legally be excluded.

Section 21 — Assignment

You may not transfer or assign your rights or obligations under these Terms without our written consent.

We may assign or transfer these Terms as part of a legitimate sale, transfer, restructuring, or reorganization of the Dry Dock Supply business, subject to applicable law.

Section 22 — Governing Law

These Terms are governed by the laws of the State of Wisconsin and applicable federal law, without regard to conflict-of-law principles.

Subject to applicable consumer-protection laws, disputes relating to these Terms or the Services may be brought in a court with lawful jurisdiction in Wisconsin.

Nothing in this section removes mandatory consumer rights or prevents a customer from bringing a claim in another jurisdiction when applicable law permits or requires it.

Section 23 — Headings

Section headings are provided for convenience and do not limit or otherwise affect the meaning of these Terms.

Section 24 — Changes to These Terms

The current version of these Terms is available on this page.

We may update these Terms to reflect changes in our Services, business practices, policies, technology, or legal obligations.

When required by law, we will provide notice of material changes.

Changes will become effective on the date stated in the updated Terms. Continued use of the Services after the effective date constitutes acceptance of the revised Terms, except where additional consent is legally required.
